IN&CO Insurance takes your rights regarding the processing of your personal data seriously. This document explains how we collect, process and use your personal data. It sets out the company’s general policy on data processing, in accordance with applicable legislation, including the General Data Protection Regulation (GDPR).

As an insurance broker, the company may have a dual role in data processing. In such cases, we act as both a data controller and a data processor. We act as a controller when we process data in our own name and on our own behalf. We also act as a processor on behalf of insurance companies. This means that we also collect and process personal data for the insurance companies with which we work and whose products we present and offer to you.

This statement relates exclusively to the processing of your data in our capacity as a data controller.

The data controllers take care to ensure that the privacy policy is properly implemented throughout IN&CO Insurance, including across all entities and departments, and by employees, third parties and other service providers who are not employees but who work under a contract with IN&CO Insurance and have access to personal data.

For requests that go beyond a simple request for information, we may ask you to verify your identity to ensure that we provide the requested information and data to the correct person.

When do we collect and process data?

The company collects and processes data about you when you contact us to obtain advice on insurance contracts, for the offering or presentation of insurance contracts, for preparatory work leading to the conclusion of insurance contracts, and for the actual conclusion of those contracts.

You may also call upon us or contact us for assistance with the administration and performance of insurance contracts you have taken out.

We also process your data when you contact us in any other way.

Finally, we may obtain data about you from third parties and use that data to contact you with a view to concluding a contract through us.

What data do we collect and process?

The company collects and processes the data you provide when you contact us, such as your name, address, email address and professional details, including your company name and VAT number.

This also includes all data necessary to enable us to assess your insurance needs. Among other things, this may include information relating to:

  • You as a driver, in connection with motor insurance;

  • Your home, in connection with home insurance;

  • Your financial situation, in connection with investment-based insurance;

  • Medical data, in connection with health insurance.

Your data is processed exclusively for the purposes of the insurance for which you use our services, unless you wish otherwise and expressly inform us of this.

We collect this data when you complete our documents and forms by hand or electronically.

Why do we collect and process data?

We process data for various purposes, which are described below.

For our customers, we process this data to manage customer relationships, particularly for the acceptance, administration and conclusion of insurance contracts, as well as to promote other products and services offered by our company.

These processing activities are primarily based on our contractual relationship with our customers and, in the case of prospecting activities, on your express consent.

For our suppliers, we process this data to manage supplier relationships and on the basis of the contractual relationship we have or are developing with them.

For prospective customers, meaning individuals who are not yet our customers, we process data for direct marketing purposes on the basis of our legitimate interest in conducting business activities.

For prospective customers contacted by email, we request express consent to contact them again in the future.

We ask prospective customers contacted by letter to tick an opt-out box if they no longer wish to be contacted by us.

For our employees, we process data for purposes such as personnel management and payroll administration.

For our websites, we adapt their content and usability to users’ needs as far as possible. We also process your data to comply with obligations arising from making a website and its content available, and to enable you to use the interactive applications and services available on these websites.

What are the legal bases for processing data?

As a rule, we collect and process your data on the basis of our contractual relationship with you, following your enquiry or request regarding an insurance need and the resulting contract or contracts, as well as your request for assistance with the administration and follow-up of insurance contracts you have taken out.

Where processing is not necessary for the performance of the contractual relationship, it is based on our legitimate interests as a company, particularly the freedom to conduct business and provide information.

In this context, we always ensure that our interests are balanced against your rights, for example by granting you the right to object.

For health data or so-called sensitive data, we may process your personal data only with your express consent.

We request this consent when you become our customer. If this has not happened, please inform us so that we can take the necessary steps.

Is data disclosed to third parties?

Your data is primarily processed internally.

IN&CO Insurance (see point 1) uses a shared database for this purpose. This does not exclude the need to disclose your data to the insurance company with which you ultimately conclude a contract.

We may engage third parties to provide certain specific services. In such cases, your data may be passed on to these third parties, but only for the provision of the service concerned and always under our company’s supervision.

In certain cases, there is a legal obligation to disclose specific data. This applies, in particular, when we are required to do so by law or when public authorities are entitled to request information from us.

As a rule, your data is not transferred to third countries or international organisations.

Your rights

The law grants you various rights designed to ensure that you are adequately protected.

You may object at any time to our company’s use of your data for direct marketing purposes.

If you do not wish to receive information about our company’s offers, you can let us know at contact@incoinsurance.be or by ticking a box in the information provided to you on certain occasions.

You may request access to the data we process about you at any time and, where necessary, ask for it to be corrected.

To do so, simply send a request to contact@incoinsurance.be, together with proof of your identity. We request this proof to prevent your data from being disclosed to someone who is not entitled to receive it.

If you disagree with the way we process your data, you may lodge a complaint at any time with the Data Protection Authority, located at Drukpersstraat 35, 1000 Brussels.
